On 23 August 2022, the International Air Services Commission (the Commission) received an application
from Virgin Australia requesting the allocation of 172 seats of passenger capacity on the Indonesia route. Virgin Australia requested the capacity on the following basis:
- the allocation is requested for a period of five years from the date of the determination;
- the capacity will be fully utilised by 31 December 2022; and
- the capacity may be utilised by Virgin Australia.
Invitation for other applications
In accordance with Section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for capacity on the route.
The closing date for making an application is 6 September 2022. If you are intending to make an application, please inform the Director of the Commission, by email (at iasc@infrastructure.gov.au), of your intention to make an application as soon as possible.

Other Application Received
On 6 September 2022, Qantas lodged an application for an allocation of 162 seats per week on the Indonesia route. The Qantas application may be found here.
Next Steps
The Commission has now received more than one application for determinations allocating available capacity on the Indonesia route. There is insufficient capacity for the Commission to make the determinations sought in all of the applications.
The Commission will write to both applicants to invite them to address the additional criteria (Section 9 of the Minister’s Policy Statement 2018) in support of their applications. Once these are received, they will be published on the IASC website and submissions about the capacity applications will be invited.
Update: 09-September-2022
The Commission has now written to both applicants inviting them to address the additional public benefit criteria as set out within section 9 of the International Air Services Commission Policy Statement 2018 by 23 September 2022.
Once responses have been received, they will be published on the Commission’s website. The Commission will then invite submissions from other interested parties about both applications.

Due to the one-off national public holiday on 22nd September 2022, the National Day of Mourning for Her Majesty the Queen, the Commission has extended the response period for both applicants to 26 September 2022, to allow for a 10 business day response period.

Section 9 - Additional Public Benefit Criteria
On 26 September 2022, the Commission received submissions from the applicants addressing the additional public benefit criteria (Section 9 of the Minister’s Policy Statement 2018) in support of their applications.

Invitation to make a submission
The Commission now invites submissions from interested parties about the airlines’ applications and their related submissions addressing the additional public benefit criteria. Interested parties have until 11 October 2022 to make a submission. If you are intending to make a submission, please inform the Director of the Commission, via email (at iasc@infrastructure.gov.au), as soon as possible.
Update: 07-November-2022
Qantas has withdrawn its application of 6 September 2022 for 162 seats of passenger capacity per week on the Indonesia route, due to a change in circumstances.
The Commission will now proceed with considering the Virgin Australia application of 24 August 2022, for 172 seats of passenger capacity on the Indonesia route, as an uncontested application.

On 7 November 2022 the Commission issued Determination [2022] IASC 121 allocating to Virgin Australia International Airlines Pty Ltd 172 seats per week of passenger capacity in each direction on the Indonesia route. The determination is valid for five years from 7 November 2022.
