NOTICE ON TRANSFER APPLICATIONS  – 27 November 2018

On 10 August 2018, the International Air Services Commission received an application from Virgin Australia seeking to vary multiple determinations to transfer the capacity allocations from Virgin Australia Airlines (SE Asia) Pty Limited (VAASEA) to Virgin Australia International Airlines Pty Limited (VAIA):

On 27 November 2018, Virgin Australia wrote to the Commission [PDF: 591 KB]   to clarify that it wishes to retain the existing conditions in the determinations, in particular the permission for the use of the capacity for the provision of code share services with certain specified airlines. These determinations to be varied are listed below:

New Zealand
  • [2017] IASC 113, as varied by [2018] IASC 109 which permits code sharing with Etihad Airways, Delta Air Lines, Singapore Airlines, Alitalia, Air Canada, Hong Kong Airlines and Hainan Airlines
Solomon Islands
  • [2016] IASC 114 which permits code sharing with Singapore Airlines
Tonga
  • [2014] IAS 112 which permits code sharing with Singapore Airlines
  • [2017] IASC 127 which permits code sharing with Singapore Airlines
Vanuatu
  • [2017] IASC 117 which permits code sharing with Singapore Airlines
  • [2017] IASC 121 which permits code sharing with Singapore Airlines

 

Invitation to comment

It may be noted that Virgin Australia’s transfer applications had been published and notified to stakeholders in August 2018 pursuant to section 22 of the International Air Services Commission Act 1992 (the Act) and no submissions were received. In the interest of transparency, the Commission notifies stakeholders of the latest request from Virgin Australia. Should any interested party wish to comment or make a submission concerning Virgin Australia’s letter of 27 November 2018, the Commission would appreciate receiving such comments by 9:00 AM (ACT local time) on 29 November 2018. Comments should be sent to the Executive Director at iasc@infrastructure.gov.au.

New Zealand - [2018] IASC 242

Which varies Determination [2017] IASC 113 to transfer the capacity allocated in the determination to Virgin Australia International Airlines Pty Ltd (VAIA) and add another condition permitting the capacity to be used by either VAIA or its wholly-owned subsidiary, Tiger International Number1 Pty Ltd. The permission is valid for the duration of the determination commencing from 1 December 2018.

Solomon Islands - [2018] IASC 243

Which varies Determination [2016] IASC 114 to transfer the capacity allocated in the determination to Virgin Australia International Airlines Pty Ltd (VAIA) and permit the capacity to be used by either VAIA or its wholly-owned subsidiary, Tiger International Number1 Pty Ltd. The permission is valid for the duration of the determination commencing from 1 December 2018.

Tonga - [2018] IASC 244

Which varies Determination [2014] IASC 112 to transfer the capacity allocated in the determination to Virgin Australia International Airlines Pty Ltd (VAIA) and permit the capacity to be used by either VAIA or its wholly-owned subsidiary, Tiger International Number1 Pty Ltd. The permission is valid for the duration of the determination commencing from 1 December 2018.
