The Commission has received an application [PDF: 448 KB] from Qantas seeking a revocation of Determination [2013] IASC 104 which allocates 6.1 units of capacity on the Japan route, and a variation of Determination [2011] IASC 128 to reduce the capacity allocated from 43.4 units to 7 units of capacity per week on the Japan route.
In accordance with subsection 27AA(3) of the International Air Services Commission Act 1992 (the Act), on receipt of a request to revoke a determination, the Commission must make a decision revoking the determination.
In relation to a request for variation of a determination where the only effect would be to reduce the capacity allocated to a carrier, the Commission is not required to invite submissions about the review of the determination pursuant to subsection 22(1A) of the Act. Subsection 24(3) requires the Commission to reduce the capacity as requested.

On 7 November 2013, the Delegate of the Commission issued Decision [2013] IASC 227 [PDF: 579 KB] revoking Determination [2013] IASC 104 and varying Determination [2011] IASC 128 to reduce the capacity allocated from 43.4 units to 7 units as requested.
