The Commission has received an application [PDF: 49 KB] from Qantas seeking a new determination for a total of 7 frequencies per week in each direction on the South Africa route. This is intended to replace the determinations currently held on the route. Qantas is also applying for the new determination to include a condition to permit SAA to code share on Qantas services until 31 March 2016. Other applications for the capacity and submissions about the code share are invited. The closing date for notice of intention to make an application is COB (i.e. 5pm) on 12 July 2012, with applications due by COB 19 July 2012. If no notice of intention is received by COB 12 July 2012, the Commission may proceed to make a decision.

Qantas did not state in its application the period for which it was seeking a new determination allocating it 7 frequencies per week. Qantas has now confirmed that it is seeking the determination for a 5 year term from the date the determination is made.

On 14 September 2012 the Commission issued Draft Determination [2012] IASC 106d [PDF: 1288 KB] proposing to allocate to Qantas seven services per week on the South Africa route and to permit South African Airways to code share on Qantas services until 31 December 2014.

The Commission invites submissions about the Draft Determination. The closing date for notice of intention to make a submission is COB (i.e. 5pm) on 24 September 2012, with submissions due by COB 1 October 2012. If no notice of intention is received by COB 24 September 2012, the Commission may proceed to make a decision.

On 19 November 2012 the Commission issued Determination [2012] IASC 106 allocating seven services per week on the South Africa route. The Determination also permits South African Airways to code share on Qantas' services until 31 December 2014, subject to conditions. The Determination may be found here  [PDF: 531 KB] .
