The Commission has received an application [PDF: 62 KB] from Qantas seeking an allocation of 3,898 seats per week on the Indonesia route, and an allocation of 729 seats and four frequencies beyond Indonesia capacity. Other applications for any or all of the capacity sought by Qantas are invited.
The closing date for notice of intention to make an application is COB 3 August 2010, with applications due by COB 10 August 2010. If no notice of intention is received by COB 3 August 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

Next Steps
The Commission will now invite all the applicants to address the paragraph 5 criteria in the Ministers policy statement by 17 August 2010.The Commission will then invite submissions about the applications. Interested parties will have until COB 25 August 2010 to notify an intention to make a submission and until COB 1 September 2010 to lodge their submission.

The Commission has extended until cob 19 August the time by which the three applicants are to make their submissions against the paragraph 5 criteria in the Minister's policy statement. There will be no change to the dates already advised for making submissions about the airlines' applications, as set out above.

Invitation to make a submission
The Commission now invites submissions from interested parties about the airlines’ applications and their related submissions addressing the paragraph 5 criteria. As advised previously, interested parties have until COB 25 August 2010 to notify an intention to make a submission and until COB 1 September 2010 to lodge the submission, unless additional time is sought and agreed to by the Commission.

The Virgin Group have written to the Commission requesting that their application for capacity on the Indonesia route be considered by the Commission as a request from Virgin Blue Airlines. The allocation sought remains the same. The letter may be found here. [PDF: 75 KB]

The Commission issued Draft Determinations [2010] IASC 107 [PDF: 145 KB] , [2010] IASC 108 [PDF: 145 KB] and [2010] IASC 109 [PDF: 145 KB] . [2010] IASC 107 allocates 1,226 seats of capacity in each direction, and two frequencies and 369 seats of passenger capacity beyond Indonesia to Qantas per week. [2010] IASC 108 allocates 1,514 seats of capacity per week in each direction to Strategic Airlines. [2010] IASC 109 allocates 1,260 seats of capacity per week in each direction to Virgin Blue Airlines.
Submissions about the draft determination are invited. The closing date for notice of intention to make a submission is COB 6 October 2010 with submissions due by COB 13 October 2010. If no notice of intention is received by COB 6 October 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.
