Cases Completed in 2015

Below is a list of the Commission's completed cases in 2015.

Hong Kong - 06 November 2015

The International Air Services Commission has received an application PDF: 299 KB ReadSpeaker from Qantas seeking an additional capacity of three frequencies on the Hong Kong and wishes to consolidate this with its current allocation of 25 frequencies on the route. In effect, Qantas is seeking to have a total allocation of 28 frequencies of passenger capacity per week on the Hong Kong route.

There are currently 45 frequencies per week available for immediate allocation to Australian carriers on the Hong Kong route.

In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 13 November 2015, with the application due by COB (i.e.5pm) 20 November 2015. If no notice of intention is received by COB 13 November 2015, the Commission may proceed to make a decision.

Update - 23 November 2015

On 23 November 2015, the Commission's delegate issued Determination [2015] IASC 115 PDF: 1496 KB ReadSpeaker allocating 28 frequencies of capacity per week in favour of Qantas on the Hong Kong route. The new determination takes effect when Determination [2014] IASC 103 is revoked. The new determination permits the capacity to be used by Qantas or another Australian carrier which is a wholly-owned subsidiary of Qantas. It also allows the capacity to be used by Qantas in joint services with any Qantas' wholly-owned subsidiary and under code share services with British Airways, Jet Airways and Finnair.

Indonesia - 13 October 2015

The International Air Services Commission has received applications from Qantas seeking allocations of:

  • 360 seats of capacity per week to enable Qantas' wholly-owned subsidiary, Jetstar Airways Pty Limited, to operate additional services on the Indonesia route during peak periods from 11 December 2015 PDF: 59 KB ReadSpeaker; and
  • 1,210 seats of capacity per week to enable Qantas' wholly-owned subsidiary, Jetstar Airways Pty Limited, to operate additional services on the Indonesia route during peak periods effective 27 March 2016 PDF: 59 KB ReadSpeaker.

Both applications seek permission for the capacity to be used by Qantas or another Australian carrier which is a wholly-owned subsidiary of Qantas and for the capacity to be utilised to provide joint services between Qantas and any wholly-owned subsidiary.

Available capacity on the Indonesia route

The Register of Available Capacity indicates there are 1,972 seats per week in each direction available for allocation to and from Sydney, Melbourne (including Avalon), Brisbane and Perth.

Other applications invited

In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 20 October 2015, with the application due by COB (i.e.5pm) 27 October 2015. If no notice of intention is received by COB 20 October 2015, the Commission may proceed to consider the applications and make decision.

Update - 04 November 2015

On 4 November 2015, the Commission issued Determination [2015] IASC 114 PDF: 1382 KB ReadSpeaker allocating 1,570 seats of capacity per week on the Indonesia route in favour of Qantas Airways Limited. The determination permits the capacity to be used by a wholly owned subsidiary including for joint services with a wholly owned subsidiary. Permission is also granted for Jetstar to use the capacity for code share services with Emirates. The determination is valid for five years from 4 November 2015.

Cook Islands - 08 October 2015

The International Air Services Commission has received an application PDF: 58 KB ReadSpeaker from Qantas seeking an allocation of 540 seats of capacity per week to operate scheduled services between Australia and the Cook Islands via New Zealand from March 2016.

In accordance with sections 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 14 October 2015, with the application due by COB (i.e. 5pm) 21 October 2015. If no notice of intention is received by COB 14 October 2015, the Commission may proceed to make a decision.

Update - 22 October 2015

On 22 October 2015, the Commission issued [2015] IASC 113 PDF: 736 KB ReadSpeaker allocating in favour of Qantas 540 seats per week of capacity on the Cook Islands route. The determination allows the capacity to be used by Qantas or its wholly-owned subsidiary and for joint services between Qantas and a wholly-owned subsidiary.

Canada - 29 September 2015

The Commission received an application PDF: 450 KB ReadSpeaker from Qantas seeking to vary Determination [2014] IASC 113 which allocates 1,092 seats per week of passenger capacity, to add conditions permitting American Airlines to codeshare on Qantas-operated services on the Canada route.

In accordance with section 22 of the International Air Services Commission Act 1992, the Commission invites submissions about the application. The closing date for notice of intention to make a submission is COB (i.e. 5pm) on 6 October 2015, with the submission due by COB (i.e. 5pm) 13 October 2015. If no notice of intention is received by COB 6 October 2015, the Commission may proceed to make a decision.

Update - 22 October 2015

On 22 October 2015, the Commission issued Decision [2015] IASC 214 PDF: 989 KB ReadSpeaker varying Determination [2014] IASC 113 to permit American Airlines to code share on Qantas-operated services between Australia and Canada.

Singapore - 16 September 2015

The Commission has received an application PDF: 491 KB ReadSpeaker from Qantas seeking an allocation of 300 seats of capacity per week on the Singapore route to be used to exercise stop-over rights between Singapore and Colombo. The application also seeks permission for Qantas and an Australian carrier which is a wholly-owned subsidiary to use the capacity; and permission to use the capacity in joint services with a wholly-owned subsidiary of the Qantas Group, with Emirates and SriLankan Airlines.

In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5:00 pm) on 23 September 2015, with the application due by COB (i.e. 5:00 pm) 30 September 2015. If no notice of intention is received by COB (i.e. 5:00 pm) 23 September 2015, the Commission may proceed to make a decision.

Update - 22 October 2015

On 22 October 2015, the Commission issued [2015] IASC 111 PDF: 1154 KB ReadSpeaker allocating in in favour of Qantas 300 seats per week of capacity on the Singapore route to be used to exercise own stop-over rights between Singapore and Colombo. The determination allows the capacity to be used by Qantas or its wholly-owned subsidiary and for joint services between Qantas and its wholly-owned subsidiary, Emirates and SriLankan Airlines.

New Zealand - 07 September 2015

The International Air Services Commission received an application PDF: 74 KB ReadSpeaker from Tasman Cargo Airlines seeking a renewal of [2005] IASC 120, as amended, which allocates unlimited freight capacity on the New Zealand route.

In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications. The closing date for notice of intention to make an application is COB (i.e. 5pm) on 14 September 2015, with the application due by COB 21 September 2015. If no notice of intention is received by COB 14 September 2015, the Commission may proceed to make a decision.

Update - 22 October 2015

On 22 October 2015, the Commission issued [2015] IASC 112 PDF: 783 KB ReadSpeaker allocating in favour of Tasman Cargo Airlines unlimited freight capacity on the New Zealand route valid for 10 years.

New Zealand - 21 September 2015

The International Air Services Commission has received an application PDF: 352 KB ReadSpeaker from Qantas seeking a variation to Determination [2014] IASC 102 allocating unlimited capacity and frequency on the New Zealand route. Qantas seeks to add conditions allowing Jetstar Airways Pt Ltd to code share with LATAM Airlines Group on the New Zealand route.

In accordance with section 22 of the International Air Services Commission Act 1992, the Commission invites submissions about the proposed variation.

The closing date for notice of intention to make a submission is COB (i.e. 5pm) Monday 28 September 2015, with the submission due by COB (i.e. 5pm) 5 October 2015. If no notice of intention is received by COB Monday 28 September 2015, the Commission may proceed to make a decision.

Update - 16 October 2015

On 16 October 2015, the Commission's delegate issued Decision [2015] IASC 213 PDF: 142 KB ReadSpeaker varying Determination [2014]IASC 102 to add conditions allowing LATAM to code share on flights operated by Jetstar Airways Pty Ltd.

Indonesia - 04 September 2015

The Commission has received an application PDF: 445 KB ReadSpeaker from Virgin Australia seeking a renewal of Determination [2011] IASC 110 which allocates 2,800 seats of capacity per week in each direction on the Indonesia route and due to expire on 29 August 2016. Virgin Australia further requests to authorise the use of the capacity by its wholly-owned subsidiary.

In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 11 September 2015, with the application due by COB 18 September 2015. If no notice of intention is received by COB 11 September 2015, the Commission may proceed to make a decision.

Update - 30 September 2015

On 30 September 2015, the Commission's delegate issued Renewal Determination [2015] IASC 110 PDF: 1286 KB ReadSpeaker allocating 2,800 seats of capacity per week in each direction on the Indonesia route in favour of Virgin Australia International Airlines Pty Ltd (VAIA). The determination permits the capacity to be used by either VAIA or another Australian carrier which is a wholly-owned subsidiary of VAIA. The determination is valid for five years from 30 August 2016.

Indonesia - 04 September 2015

The Commission has received an application PDF: 339 KB ReadSpeaker from Virgin Australia seeking a variation to the following determinations on the Indonesia route:

to permit a wholly-owned subsidiary of Virgin Australia to use the capacity.

On 24 September 2015, the Commission issued the following decisions to permit an Australian carrier that is a wholly-owned subsidiary of Virgin Australia International Airlines Pty Ltd to use the capacity on the Indonesia route:

United Kingdom - 18 August 2015

Renewal of Determination [2006] IASC 105 – Qantas.

The International Air Services Commission received an application from Qantas for the renewal of Determination [2006] IASC 105 PDF: 42 KB ReadSpeaker which allocates unlimited capacity on the United Kingdom route that expires on 31 August 2016. 

In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) Tuesday 25 August 2015, with the application due by COB 1 September 2015. If no notice of intention is received by COB Tuesday 25 August 2015, the Commission may proceed to make a decision.

Update - 04 September 2015

On 4 September 2015, the Commission issued Determination [2015] IASC 108 PDF: 1194 KB ReadSpeaker renewing the allocation of unlimited passenger capacity on the United Kingdom route in accordance with the terms of the Australia-UK air services arrangements.

China - 18 August 2015

The International Air Services Commission received an application PDF: 53 KB ReadSpeaker from Qantas seeking an allocation of unlimited capacity on the China route between points in Australia other than Sydney, Melbourne, Brisbane and Perth, and points in China other than Beijing, Shanghai and Guangzhou. The allocation is requested for a period of ten years from the date of determination.

In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) Tuesday 25 August 2015, with the application due by COB 1 September 2015. If no notice of intention is received by COB Tuesday 25 August 2015, the Commission may proceed to make a decision.

Update - 04 September 2015

On 4 September 2015, the Commission issued Determination [2015] IASC 109 PDF: 917 KB ReadSpeaker allocating unlimited passenger capacity between points in Australia other than Sydney, Melbourne, Brisbane and Perth and points in China in accordance with the terms of the Australia-China air services arrangements.

Chile - 24 June 2015

The International Air Services Commission (the Commission) has received an application PDF: 347 KB ReadSpeaker from Qantas seeking the following:

  • additional capacity of 364 seats per week in each direction on the Chile route;
  • consolidation of all the existing capacity entitlements allocated to Qantas under other determinations—namely, [2014] IASC 111 and [2011] IASC 114 as amended.

This will bring the total amount of capacity allocation to 1,847 seats per week.

Additionally, Qantas has sought the inclusion of certain conditions (set out in the application) in the consolidated determination.

In accordance with section 12 of the International Air Services Commission Act 1992 (the Act), the Commission invites other applications for the additional capacity applied for by Qantas. Further, the Commission invites submissions about the proposed variation (i.e. consolidation of capacity) pursuant to section 22 of the Act.

The closing date for notice of intention to make an application or submission is COB (i.e. 5 pm) on 1 July 2015, with the application or submission due by COB 8 July 2015. If no notice of intention is received by COB 1 July 2015, the Commission may proceed to make a determination/decision.

Update - 15 July 2015

On 15 July 2015, the Commission's delegate issued Determination [2015] IASC 107 PDF: 1036 KB ReadSpeaker allocating 1,847 seats of capacity per week on the Chile route in favour of Qantas Airways Limited.

Taiwan - 19 June 2015

The International Air Services Commission has received an application PDF: 167 KB ReadSpeaker from Qantas seeking a renewal of Determination [2011] IASC 106 which allocates 2121 seats of capacity per week in each direction on the Taiwan route. Qantas is seeking to vary the Determination to hand back 861 seats and retain 1,260 seats for a further five-year period from 7 June 2016.

The Determination is due to expire on 6 June 2016. In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 26 June 2015, with the application due by COB 3 July 2015. If no notice of intention is received by COB 26 June 2015, the Commission may proceed to make a decision.

On 14 July 2015, the Commission’s delegate issued Renewal Determination [2015] IASC 106 PDF: 1036 KB ReadSpeaker allocating 1,260 seats of capacity per week on the Taiwan route in favour of Qantas Airways Limited.

France-Route 3 (New Caledonia) - 05 June 2015

The International Air Services Commission has received an application PDF: 159 KB ReadSpeaker from Qantas seeking a renewal of Determination [2010] IASC 112 which allocates 239 seats of capacity per week in each direction on the France-Route 3 (New Caledonia). The Determination is due to expire on 20 May 2016. In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 12 June 2015, with the application due by COB 19 June 2015. If no notice of intention is received by COB 12 June 2015, the Commission may proceed to make a decision.

On 24 June 2015, the Commission issued in favour of Qantas Renewal Determination [2015] IASC 105 PDF: 925 KB ReadSpeaker allocating 239 seats of capacity per week in each direction on the France–Route 3 (New Caledonia) route.

Papua New Guinea - 28 May 2015

The International Air Services Commission has received an application PDF: 255 KB ReadSpeakerfrom Pacific Air Express seeking a renewal of Determination [2010] IASC 105 which allocates 17.5 tonnes of all-cargo capacity per week in each direction on the Papua New Guinea route. The Determination is due to expire on 24 June 2015. On 5 June 2015, the Commission's delegate issued Renewal Determination [2015] IASC 104 PDF: 727 KB ReadSpeaker which allocates 17.5 tonnes of all-cargo capacity per week on the Papua New Guinea route to Pacific Air Express (Australia) Pty Ltd.

Papua New Guinea - 16 April 2015

The International Air Services Commission has received an application PDF: 131 KB ReadSpeaker from Pacific Air Express seeking a renewal of Determination [2011] IASC 102 which allocates 17.5 tonnes of all-cargo capacity per week in each direction on the Papua New Guinea route and expires on 4 April 2016. In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 23 April 2015, with the application due by COB 30 April 2015. If no notice of intention is received by COB 23 April 2015, the Commission may proceed to make a decision.

On 24 April 2015, the Commission's delegate issued Renewal Determination [2015] IASC 103 PDF: 726 KB ReadSpeaker which allocates 17.5 tonnes of all-cargo capacity per week on the Papua New Guinea route to Pacific Air Express (Australia) Pty Ltd.

Papua New Guinea - 17 February 2015

The International Air Services Commission has received an application PDF: 216 KB ReadSpeaker from Virgin Australia seeking an allocation of 172 seats of capacity on the Papua New Guinea route.

In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB 24 February 2015, with the application due by COB 3 March 2015. If no notice of intention is received by COB 24 February 2015, the Commission may proceed to make a decision.

Update - 27 February 2015

On 25 February 2015, the Commission issued Determination [2015] IASC 102 PDF: 725 KB ReadSpeaker allocating 172 seats per week of capacity to Virgin Australia on the Papua New Guinea route. The determination is valid for five years.

Fiji - 23 December 2014

The International Air Services Commission received an application PDF: 452 KB ReadSpeaker from Qantas seeking an allocation of unlimited capacity on the Fiji route between points in Australia other than Sydney, Melbourne, Brisbane and Perth, and authorised points in Fiji. Qantas' wholly-owned subsidiary, Jetstar Airways Pty Limited, plans to operate services between the Gold Coast and Fiji from March 2015. In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 2 January 2015, with the application due by COB 9 January 2015. If no notice of intention is received by COB 2 January 2015, the Commission may proceed to make a decision.

Update - 06 January 2015

On 6 January 2015, Delegate of the Commission issued Determination [2015] IASC 101 [PDFPDF: 1612 KB], allocating unlimited capacity on the Fiji route between points in Australia other than Sydney, Melbourne, Brisbane and Perth, and points in Fiji.
