Below is a list of the Commission's completed cases in 2014.

Philipines - 23 October 2014

The Commission has received an application PDF: 128 KB ReadSpeaker from Qantas seeking a renewal of Determination [2010] IASC 123 which allocates 531 seats of capacity per week in each direction on the Philippines route and expires on 24 October 2015. In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 30 October 2014, with the application due by COB 6 November 2014. If no notice of intention is received by COB 30 October 2014, the Commission may proceed to make a decision.

On 22 December 2014, the Commission issued Determination [2014] IASC 115 [PDFPDF: 2383 KB] [ReadSpeaker], allocating 531 seats per week on the Philippines route.

Japan - 01 December 2014

The International Air Services Commission received an application PDF: 387 KB ReadSpeaker from Qantas seeking an allocation of seven frequencies per week of capacity on the Japan route to serve Haneda Airport. In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 8 December 2014, with the application due by COB 15 December 2014. If no notice of intention is received by COB 8 December 2014, the Commission may proceed to make a decision.

On 16 December 2014, the Commission issued Determination [2014] IASC 120 [PDFPDF: 930 KB] [ReadSpeaker], allocating 7 frequencies per week on the Japan route to serve Haneda Airport.

Various Routes - 31 October 2014

The Commission has received an application PDF: 350 KB ReadSpeaker from Virgin Australia seeking a renewal of multiple determinations:

  • Determination [2010] IASC 122 (as varied), which allocates five frequencies per week of capacity on the Bangladesh route;
  • Determination [2010] IASC 120 (as varied), which allocates 150 seats one way per day (on an average annual basis) of code share capacity on the France route;
  • Determination [2010] IASC 119 (as varied), which allocates seven frequencies per week of third country code share capacity on the Thailand route; and
  • Determination [2010] IASC 118 (as varied), which allocates three frequencies per week of capacity on the United Arab Emirates route.

In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity on any or all of the above routes.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 7 November 2014, with the application due by COB 14 November 2014. If no notice of intention is received by COB 7 November 2014, the Commission may proceed to make a decision.

United Arab Emirates (UAE)

Thailand

France

Cook Islands - 10 October 2014

The Commission has received an application PDF: 192 KB ReadSpeaker from Virgin Australia seeking a renewal of Determination 2009 [IASC] 129 (as varied), which allocates 180 seats per week of capacity on the Cook Islands route. In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 17 October 2014, with the application due by COB 24 October 2014. If no notice of intention is received by COB 17 October 2014, the Commission may proceed to make a decision.

Singapore - 17 September 2014

The Commission has received an application PDF: 449 KB ReadSpeaker from Qantas to vary Determinations [2007] IASC 116 (as varied) and [2013] IASC 120 to permit Qantas and SriLankan Airlines to code share on the Singapore route. In accordance with section 22 of the International Air Services Commission Act 1992, the Commission invites submissions about the application.

The closing date for notice of intention to make an application is COB 24 September 2014, with the application due by COB 1 October 2014. If no notice of intention is received by COB 24 September 2014, the Commission may proceed to make a decision.

Canada - 17 September 2014

Vanuatu - 28 August 2014

The Commission has received an application [PDFPDF: 231 KB] [ReadSpeaker] from Virgin Australia seeking a variation to Determinations [2013] IASC 108 and [2013] IASC 109 to permit the use of the capacity for code share services with Singapore Airlines on the Vanuatu route.

On 8 September 2014, the Commission varied Determinations [2013] IASC 108 and [2013] IASC 109 [PDFPDF: 1072 KB] [ReadSpeaker], to permit Singapore Airlines to code share on Virgin Australia services on the Vanuatu route.

Chile - 29 July 2014

The Commission has received an application [PDFPDF: 53 KB] [ReadSpeaker] from Qantas seeking an allocation of 364 seats of capacity on the Chile route. In accordance with section 12 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

Hong Kong - 18 July 2014

The Commission has received an application [PDFPDF: 44 KB] [ReadSpeaker] from Qantas seeking a renewal of Determination [2009] IASC 124, which allocates one all-cargo frequency per week on the Hong Kong route and expires on 13 July 2015. In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 28 July 2014, with the application due by COB 4 August 2014. If no notice of intention is received by COB 28 July 2014, the Commission may proceed to make a decision.

Update - 01 August 2014

On 1 August 2014, the Commission issued Renewal Determination [2014] IASC 110 [PDFPDF: 129 KB] [ReadSpeaker], allocating one all-cargo frequency per week to Qantas on the Hong Kong route.

Papua New Guinea - 10 June 2014

On 10 June 2014, Qantas applied to the Commission [PDFPDF: 46 KB] [ReadSpeaker], seeking a variation to Determination [2013] IASC 123 to reduce freight capacity to from 35 to 17.5 tonnes per week. As the application involves a reduction in capacity, the application does not require consultation.

Update - 27 June 2014

On 27 June 2014, the Commission issued Decision [2014] IASC 229 [PDFPDF: 374 KB] [ReadSpeaker], varying [2013] IASC 123 to reduce the capacity allocated to Qantas from 35 to 17.5 tonnes per week, and to extend the date by which the capacity is to be utilised to 31 May 2015.

Italy - 06 June 2014

The Commission has received an application from Qantas [PDFPDF: 161 KB] [ReadSpeaker] seeking a renewal of Determination [2010] IASC 104 which allocates 400 seats of third country code share capacity per week on the Italy route and expires on 7 June 2015. In accordance with sections 12 and 17 of the International Air Services Commission Act 1992, the Commission invites other applications for the capacity.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 13 June 2014, with the application due by COB 20 June 2014. If no notice of intention is received by COB 13 June 2014, the Commission may proceed to make a decision.

On 27 June 2014, the Commission issued Renewal Determination [2014] IASC 109 [PDFPDF: 1354 KB] [ReadSpeaker], allocating 400 seats of third country code share capacity per week to Qantas on the Italy route.

Tonga - 16 May 2014

The Commission has received an application [PDFPDF: 244 KB] [ReadSpeaker] from Virgin Australia to vary the following determinations to permit Singapore Airlines to code share on flights operated by Virgin Australia on the Tonga route:

  • Determination [2009] IASC 130 allocating 360 seats per week; and
  • Determination [2013] IASC 113 allocating 180 seats per week.

The Commission invites, pursuant to section 22 of the International Air Services Commission Act 1992, submissions about the application for variation. The closing date for notice of intention to make an application is COB (i.e. 5pm) on 23 May 2014, with the application due by COB 30 May 2014. If no notice of intention is received by COB 23 May 2014, the Commission may proceed to make a decision.

Papua New Guinea - 08 May 2014

Singapore - 02 May 2014

Renewal - Virgin Australia - Cook Islands - 07 April 2014

Papua New Guinea - 04 April 2014

The Commission has received an application [PDFPDF: 133 KB] [ReadSpeaker] from Pacific Air Express to renew Determination [2009] IASC 134 which allocates 17.5 tonnes of freight capacity weekly on the Papua New Guinea route. Other applications for capacity are invited.

On 15 April 2014, the Delegate, on behalf of the Commission issued Renewal Determination [2014] IASC 106 [PDFPDF: 706 KB] [ReadSpeaker], allocating 17.5 tonnes of freight capacity per week in each direction on the PNG route to Pacific Air Express.

Renewal - Qantas - Papua New Guinea - 26 March 2014

The Commission has received an application [PDFPDF: 38 KB] [ReadSpeaker] from Qantas to renew Determination [2010] IASC 101, which allocates 888 seats per week of capacity on the Papua New Guinea route. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 2 April 2014, with the application due by COB 9 April 2014. If no notice of intention is received by COB 2 April 2014, the Commission may proceed to make a decision.

Update - 10 April 2014

On 10 April 2014, the Delegate, on behalf of the Commission, issued Renewal Determination [2014] IASC105 [PDFPDF: 712 KB] [ReadSpeaker], reallocating 888 seats per week on the PNG route to Qantas for a further five years.

Thailand - 14 February 2014

The Commission has received a set of applications [PDFPDF: 368 KB] [ReadSpeaker] from Qantas seeking variations to various determinations on the Thailand route to effectively consolidate its multiple determinations on the route.

Qantas holds nine current determinations on the Thailand route which allocate a total of:

  • 12.6 B747 equivalent units per week in each direction for passenger services; and
  • 56 third country code share frequencies per week between Australia and Thailand.

The proposed variations

Qantas requests a variation to Determination [2011] IASC 123 to increase the capacity allocation to a total of:

  • 12.6 B747 equivalent units per week in each direction for passenger services; and
  • 56 third country code share frequencies per week between Australia and Thailand.

Qantas further seeks to vary the following determinations to amend their expiry dates to the date when the variation to Determination [2011] IASC 123 takes effect, should a variation be granted by the Commission:

The closing date for submitting a notice of intention to make a submission is COB (i.e. 5 pm) on 20 February 2014, with the submission due by COB 27 February 2014.

If no notice of intention is received by COB 20 February 2014, the Commission may proceed to make a decision.

Update - 25 February 2014

Update - 17 March 2014

On 14 March 2014, the Commission issued Decision [2014] IASC 211 [PDFPDF: 1749 KB] [ReadSpeaker] , which consolidates all of Qantas' capacity on the Thailand route into [2011] IASC 123.

The Delegate of the Commission will issue separate decisions to vary Qantas' other determinations to change their expiry dates to the date when the variation above comes into effect.

On the 18 March 2014, the Delegate of the Commission issued the following Decisions varying the expiry dates of the following determinations so that they expire on 14 March 2014:

New Zealand - 14 February 2014

The Commission has received an application [PDFPDF: 452 KB] [ReadSpeaker] from Qantas seeking a new allocation of unlimited passenger and freight capacity on the New Zealand route in order to include new conditions and consolidate various conditions contained in multiple decisions.

In accordance with section 12 of the International Air Services Commission Act 1992 (the IASC Act), the Commission invites other applications for allocation of capacity on the New Zealand route.

Furthermore, as the Qantas’ application is also a variation of Determination [2006] IASC 109 to include new conditions, the Commission is inviting submissions about the application in accordance with section 22 of the IASC Act. Qantas is seeking permission to include the following new conditions:

  • the capacity may be used by Qantas to provide services jointly with Japan Airlines;
  • the capacity may be used by Qantas to provide services jointly with China Southern Airlines; and
  • the capacity may be used by Jetstar to provide services jointly with American Airlines.

The closing date for submitting a notice of intention to make an application or submission is COB (i.e. 5 pm) on 20 February 2014, with the application or submission due by COB 27 February 2014.

If no notice of intention is received by COB 20 February 2014, the Commission may proceed to make a decision.

Update - 17 March 2014

On 14 March 2014, the Commission issued Determination [2014] IASC 102 [PDFPDF: 2164 KB] [ReadSpeaker] allocating unlimited passenger and freight capacity to Qantas on the New Zealand route, consolidating all conditions contained in multiple decisions on the route.

Hong Kong - 14 February 2014

The Commission has received an application [PDFPDF: 298 KB] [ReadSpeaker] from Qantas proposing a consolidation of its multiple determinations on the Hong Kong route. Qantas currently holds three determinations allocating a total of 25 frequencies per week on the Hong Kong route.

In accordance with section 12 of the International Air Services Commission Act 1992 (the IASC Act), the Commission invites other applications for allocation of capacity on the Hong Kong route.

Furthermore, as Qantas’ application is also effectively a variation of its multiple determinations on the route to include a new condition, the Commission is inviting submissions about the application in accordance with section 22 of the IASC Act. Qantas is seeking permission to code share with British Airways on the Hong Kong route (in addition to the other code share arrangements already approved).

The closing date for submitting a notice of intention to make an application or submission is COB (i.e. 5 pm) on 20 February 2014, with the submission due by COB 27 February 2014.

If no notice of intention is received by 20 February 2014, the Commission may proceed to make a decision.

Update - 17 March 2014

On 14 March 2014, the Commission issued Determination [2014] IASC 103 [PDFPDF: 1491 KB] [ReadSpeaker], which consolidates capacity currently held by Qantas on the Hong Kong route under multiple determinations. The determination also allows the capacity to be used by Qantas to provide joint services with any wholly-owned subsidiary, Jet Airways, British Airways and Finnair. This determination takes effect when the current determinations are revoked.

Korea - 19 February 2014

The Commission has received an application [PDFPDF: 224 KB] [ReadSpeaker] from Virgin Australia seeking an allocation of 1,000 seats per week. Virgin Australia intend to implement code share services, as a marketing carrier, on flights operated by Singapore Airlines.

In accordance with section 22 of the International Air Services Commission Act 1992, the Commission invites applications for the capacity. The closing date for notice of intention to make an application is COB (i.e. 5 pm) on 26 February 2014, with the application due by COB 5 March 2014.

If no notice of intention is received by COB 26 February 2014, the Commission may proceed to make a decision.

Update - 17 March 2014

On 14 March 2014, the Commission issued Determination [2014] IASC 104 [PDFPDF: 1187 KB] [ReadSpeaker] allocating to Virgin Australia 1000 seats per week and permitting Virgin Australia to use the capacity to code share with Singapore Airlines on the route.

Various Routes - 14 February 2014

The Commission has received an application [PDFPDF: 249 KB] [ReadSpeaker] from Qantas seeking to vary the following determinations to add a condition permitting Emirates to code share on Jetstar-operated services:

New Zealand - 04 February 2014

The Commission has received an application [PDFPDF: 359 KB] [ReadSpeaker] from Qantas seeking a variation to Determination [2006] IASC 109 to permit Japan Airlines to code share on Qantas operated services on the New Zealand route.

In accordance with section 22 of the International Air Services Commission Act 1992, the Commission invites submissions about Qantas’ proposed variation. Indonesia - 04 November 2013

The Commission has received an application [PDFPDF: 382 KB] [ReadSpeaker] from Qantas seeking variations to various determinations on the Indonesia route to effectively consolidate its multiple determinations on the route.

Qantas holds 10 determinations on the Indonesia route which allocate a total of:

  • 14,468 seats of capacity per week for the exercise of third and fourth freedom traffic rights; and
  • 2,146 seats with 12 frequencies per week, beyond Indonesia, seven of which may serve Denpasar.

Additionally, Qantas holds Determination [2013] IASC 135 which allocates unlimited passenger capacity on the route between points in Australia, except Sydney, Melbourne, Brisbane and Perth and points in Indonesia, valid for 10 years.

The proposed variations

Qantas requests a variation to Determination [2013] IASC 115 to increase the allocation to a total of 14,468 seats per week and beyond Indonesia to 2,148 seats and 12 frequencies, seven of which may serve Denpasar. Qantas, in effect, proposes to consolidate its 10 determinations on the Indonesia route.

Qantas further seeks to vary the following determinations to amend their expiry dates to the date when the variation to Determination [2013] IASC 115 takes effect, should a variation be granted by the Commission:

Submissions invited

In accordance with section 22 of the International Air Services Commission Act 1992, the Commission invites submissions about Qantas’ proposed variations. The closing date for notice of intention to make a submission is COB (i.e. 5 pm) on 11 November 2013, with the submission due by COB 18 November 2013.

If no notice of intention is received by COB 11 November 2013, the Commission may proceed to make a decision.

Update - 04 February 2014

Renewal - Qantas - Philippines - 16 December 2013

The Commission has received an application [PDFPDF: 245 KB] [ReadSpeaker] from Qantas to renew Determination [2008] IASC 123 which allocates 129 seats per week on the Philippines route. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 24 December 2013, with the application due by COB 6 January 2014. If no notice of intention is received by COB 24 December 2013, the Commission may proceed to make a decision.

Update - 09 January 2014

On 8 January 2014 the Delegate of the Commission issued Renewal Determination [2014] IASC 101[PDFPDF: 777 KB] [ReadSpeaker] allocating 129 seats of capacity per week in each direction as requested.
