Below is a list of the Commission's completed cases in 2010.

Japan - 25 November 2010

The Commission has received an application from Qantas [PDFPDF: 74 KB] [ReadSpeaker] seeking a variation to Determination [2007] IASC 108 which allocates capacity on the Japan route to permit Japan Airlines to code share on Qantas operated services. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB 2 December 2010, with submissions due by COB 9 December 2010. If no notice of intention is received by COB 2 December 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

On 10 December 2010, the Commission issued Decision [2010] IASC 213 [PDFPDF: 81 KB] [ReadSpeaker], varying Determination [2007] IASC 108 to permit Japan Airlines to code share on Qantas services.

Japan - 19 October 2010

The Commission has received an application from Qantas [PDFPDF: 258 KB] [ReadSpeaker] seeking to extend and vary current authorisations that permit Jetstar Airways to code share with Japan Airlines on selected Jetstar services. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB 26 October 2010, with submissions due by COB 2 November 2010. If no notice of intention is received by COB 26 October 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

Update - 16 November 2010

On 11 November 2010, the Commission issued Determination [2010] IASC 210 [PDFPDF: 113 KB] [ReadSpeaker] varying Determinations [2006] IASC 117, [2006] IASC 124 and [2008] IASC 127 to permit Jetstar Airways to code share with Japan Airlines as requested.

Thailand - 19 October 2010

The Commission has received an application from Qantas [PDFPDF: 68 KB] [ReadSpeaker] for a variation to Determination [2006] IASC 110 to permit Kenya Airways to code share on Qantas operated passenger services on the Thailand route. Qantas is also seeking an allocation of seven frequencies per week for third country code share services on the Thailand route to enable Qantas to code share on Kenya Airways operated services beyond Thailand. Submissions about the application and other applications for the capacity are invited.

The closing date for notice of intention to make a submission or an application is COB 26 October 2010, with submissions or applications due by COB 2 November 2010. If no notice of intention is received by COB 26 October 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

Update - 01 November 2010

On 27 October 2010, the Delegate of the Commission issued Decision [2010] IASC 209 [PDFPDF: 83 KB] [ReadSpeaker] which varies Determination [2006] IASC 110 by permitting Kenya Airways to code share on Qantas operated services as requested. The Delegate of the Commission also issued Determination [2010] IASC 124 [PDFPDF: 92 KB] [ReadSpeaker], allocating seven weekly third party code share services in each direction on the route.

Renewal of determinations expiring in 2011 - 14 October 2010

Qantas has applied to the Commission to renew a number of determinations. The application may be viewed here [PDFPDF: 84 KB] [ReadSpeaker].

The determinations subject to renewal and any subsequent variations to the determinations may be viewed on the Commission website under Determinations and Decisions.

Other applications for the capacity are invited. The closing date for notice of intention to make an application is 21 October 2010, with applications due by 28 October 2010, unless additional time is sought and agreed to by the Commission.

Update - 19 October 2010

As part of the renewals process Qantas requested that Determinations [2006] IASC 102 and [2008] IASC 108, which both allocated capacity on the Vietnam route, be revoked as the capacity was no longer required. The Delegate of the Commission issued Decision [2010] IASC 207 [PDFPDF: 76 KB] [ReadSpeaker] on 14 October 2010 revoking the determinations as requested.

On 25 October 2010 the Commission issued the following Renewal Determinations:

Philippines - 14 October 2010

The Commission has received an application from Qantas [PDFPDF: 44 KB] [ReadSpeaker] for an allocation of 531 seats per week on the Philippines route. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB 21 October 2010, with applications due by COB 28 October 2010. If no notice of intention is received by COB 21 October 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

On 25 October 2010 the Commission issued Determination [2010] IASC 123 [PDFPDF: 89 KB] [ReadSpeaker] allocating 531 seats of capacity in each direction on the route to Qantas.

New Zealand - 04 October 2010

The Commission has received an application from Pacific Blue Australia [PDFPDF: 49 KB] [ReadSpeaker] for a variation to Determination [2007] IASC 118, which allocates capacity on the New Zealand route, to enable Etihad Airlines to code share on its services between Australia and Auckland and Christchurch. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB 11 October 2010, with submissions due by COB 18 October 2010. If no notice of intention is received by COB 11 October 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

On 25 October 2010 the Commission issued Decision [2010] IASC 208 [PDFPDF: 86 KB] [ReadSpeaker] permitting Etihad Airlines to code share on Pacific Blue Australia services between Australia and New Zealand.

Thailand, France, Greece, Bangladesh and UAE - 04 October 2010

The Commission has received an application from V Australia [PDFPDF: 137 KB] [ReadSpeaker] for approval of code share arrangements between V Australia and Etihad Airways on the Thailand, Greece, Bangladesh and UAE routes, and an application for capacity on the France, Greece, Bangladesh and UAE routes. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB 11 October 2010, with applications due by COB 18 October 2010. Thailand - 28 September 2010

The Commission has received an application from Strategic Airlines [PDFPDF: 28 KB] [ReadSpeaker] seeking an allocation of the equivalent of 4.2 B747 aircraft each week on the route. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB 5 October 2010, with applications due by COB 12 October 2010. If no notice of intention is received by COB 5 October 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

On 13 October 2010, the Delegate of the Commission issued Determination [2010] IASC 111 [PDFPDF: 81 KB] [ReadSpeaker] allocating 4.2 B747 equivalent services per week on the Thailand route. The determination is for five years.

Fiji - 13 September 2010

The Commission has received an application [PDFPDF: 132 KB] [ReadSpeaker] to vary Determinations [2009] IASC 131 and [2008] IASC 129,which together allocate 2,167 seats per week of capacity to V Australia, to transfer the capacity to Pacific Blue Australia. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB 20 September 2010 with submissions due by COB 27 September 2010. If no notice of intention is received by COB 20 September 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

Update - 29 September 2010

The Commission issued Decision [2010] IASC 205 [PDFPDF: 87 KB] [ReadSpeaker] varying Determinations [2008] IASC 129 and [2009] IASC 131 as requested by V Australia, by transferring from V Australia to Pacific Blue Australia the allocations of capacity made in those determinations, being respectively 1,260 seats of capacity per week and 907 seats of capacity per week.

Indonesia - 13 September 2010

The Commission has received an application [PDFPDF: 76 KB] [ReadSpeaker] to vary all Determinations currently allocating capacity to Pacific Blue Australia to transfer the allocated capacity to Virgin Blue Airlines. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB 20 September 2010 with submissions due by COB 27 September 2010. If no notice of intention is received by COB 20 September 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

The Commission issued Decision [2010] IASC 206 [PDFPDF: 73 KB] [ReadSpeaker] varying Determinations [2008] IASC 120, [2009] IASC 103, [2009] IASC 105, [2009] IASC 106, [2009] IASC 107 and [2009] IASC 113, as requested by Pacific Blue Australia, by transferring from Pacific Blue Australia to Virgin Blue Airlines the allocations of capacity made in those determinations.

China - 26 August 2010

The Commission has received an application [PDFPDF: 40 KB] [ReadSpeaker] from Qantas seeking a variation of Determination [2008] IASC 121 to increase the allocation of seats by 166 per week in each direction. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB 2 September 2010 with submissions due by COB 9 September 2010. If no notice of intention is received by COB 2 September 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

On 13 September 2010 the Commission issued Decision [2010] IASC 203 [PDFPDF: 87 KB] [ReadSpeaker] varying Determination [2008] IASC 121 by increasing the allocation of seats by 166 per week in each direction.

Indonesia - 27 July 2010

The Commission has received an application [PDFPDF: 61 KB] [ReadSpeaker] from Qantas seeking an allocation of 3,898 seats per week on the Indonesia route, and an allocation of 729 seats and four frequencies beyond Indonesia capacity. Other applications for any or all of the capacity sought by Qantas are invited.

The closing date for notice of intention to make an application is COB 3 August 2010, with applications due by COB 10 August 2010. If no notice of intention is received by COB 3 August 2010, the Commission may proceed to decide matters under consideration as soon as practicable after that date.

Next Steps

The Commission will now invite all the applicants to address the paragraph 5 criteria in the Ministers policy statement by 17 August 2010.The Commission will then invite submissions about the applications. Interested parties will have until COB 25 August 2010 to notify an intention to make a submission and until COB 1 September 2010 to lodge their submission.

Update - 18 August 2010

The Commission has extended until cob 19 August the time by which the three applicants are to make their submissions against the paragraph 5 criteria in the Minister's policy statement. There will be no change to the dates already advised for making submissions about the airlines' applications, as set out above.

Invitation to make a submission

The Commission now invites submissions from interested parties about the airlines’ applications and their related submissions addressing the paragraph 5 criteria. As advised previously, interested parties have until COB 25 August 2010 to notify an intention to make a submission and until COB 1 September 2010 to lodge the submission, unless additional time is sought and agreed to by the Commission.

The Commission issued Draft Determinations [2010] IASC 107 [PDFPDF: 143 KB] [ReadSpeaker], [2010] IASC 108 [PDFPDF: 143 KB] [ReadSpeaker] and [2010] IASC 109 [PDFPDF: 143 KB] [ReadSpeaker]. [2010] IASC 107 allocates 1,226 seats of capacity in each direction, and two frequencies and 369 seats of passenger capacity beyond Indonesia to Qantas per week. [2010] IASC 108 allocates 1,514 seats of capacity per week in each direction to Strategic Airlines. [2010] IASC 109 allocates 1,260 seats of capacity per week in each direction to Virgin Blue Airlines.

[2010] IASC 107 allocates 1226 seats of capacity per week in each direction on the Indonesia route, and two frequencies and 369 seats of passenger capacity beyond Indonesia to Qantas. [2010] IASC 108 allocates 1514 seats of capacity per week in each direction on the Indonesia route to Strategic Airlines. [2010] IASC 109 allocates 1260 seats of capacity per week in each direction on the Indonesia route to Virgin Blue.

South Africa - 29 June 2010

The Commission has received an application [PDFPDF: 474 KB] [ReadSpeaker] from Qantas seeking an extension, for a further two years from 31 December 2010, of the current authorisations that permit Qantas to code share with South African Airways on Qantas services between Sydney and Johannesburg. Update - 19 August 2010

The Commission has today issued a draft decision [PDFPDF: 159 KB] [ReadSpeaker] proposing to continue authorisation of the Qantas/South African Airways arrangements beyond the current expiry date of 31 December 2010 for a further 12 months, that is, until 31 December 2011.

The Commission invites submissions from interested parties about the draft decision. Interested parties have until COB 26 August 2010 to notify an intention to make a submission and until COB 2 September 2010 to lodge the submission, unless additional time is sought and agreed to by the Commission.

Update - 09 September 2010

The Commission issued a second draft decision [PDFPDF: 170 KB] [ReadSpeaker] today confirming its intention to continue authorisation of the Qantas/South African Airways arrangements beyond the current expiry date of 31 December 2010 for a further 12 months. The Commission has now included in the decision a requirement for Qantas and South African Airways to expand the combined number of frequencies per week from 12 to 14.

The Commission now invites submissions from interested parties about this draft decision. Interested parties will have until COB 16 September 2010 to notify an intention to make a submission and until COB 23 September 2010 to lodge the submission, unless additional time is sought and agreed to by the Commission.

Indonesia - 24 June 2010

On 8 July 2010, the Delegate on behalf of the Commission issued Determination [2010] IASC 106 [PDFPDF: 85 KB] [ReadSpeaker] allocating unrestricted passenger capacity in each direction on the route to Strategic Airlines.

Papua New Guinea - 15 June 2010

The Commission has received an application [PDFPDF: 84 KB] [ReadSpeaker] from Pionair Australia for an allocation of 18 tonnes of freight capacity on the Papua New Guinea route. On Tuesday 15 June 2010, Pionair revised the amount of capacity sought, and has reduced its application to 12 tonnes of capacity per week, via email correspondence. Other applications for the capacity sought by Pionair are invited.

The closing date for notice of intention to make an application is COB 22 June 2010, with applications due by COB 29 June 2010. If no notice of intention is received by COB 22 June 2010, the Commission may proceed to decide the matters under consideration as soon as practicable after that date.

The Commission issued Interim Determination [2010] IASC 110 [PDFPDF: 91 KB] [ReadSpeaker] allocating Pionair twelve tonnes of freight capacity per week in each direction. The determination is for three years.

Papua New Guinea - 07 June 2010

The Commission has received an application [PDFPDF: 95 KB] [ReadSpeaker] from Pacific Air Express (Australia) Pty Ltd (ABN 26 074 265 553) seeking an allocation of 17.5 tonnes of freight capacity on the Papua New Guinea route. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB 14 June 2010, with applications due by COB 21 June 2010. If no notice of intention is received by COB 14 June 2010, the Commission may proceed to decide the matters under consideration as soon as practicable after that date.

Italy - 01 June 2010

Update - 08 June 2010

On 8 June 2010, the Delegate of the Commission issued Determination [2010] IASC 104 [PDFPDF: 86 KB] [ReadSpeaker], allocating 400 third-country code share seats per week in each direction on the Italy route. The determination is for five years from the date of the determination.

Singapore - 11 May 2010

The Commission has received an application [PDFPDF: 65 KB] [ReadSpeaker] from Qantas Airways Limited (ACN 009 661 901) (Qantas) seeking a variation to Determination [2007] IASC 116 [PDFPDF: 101 KB] [ReadSpeaker] which allocates capacity on the Singapore route. The variation sought would permit China Eastern Airlines to code share on Qantas services between Australia and Singapore. Submissions about this application are invited.

The closing date for notice of intention to make an application is COB 18 May 2010, with submissions due by COB 25 may 2010. If no notice of intention is received by COB 18 may 2010, the Commission may proceed to decide on the matters under consideration as soon as practicable after that date.

On the 25 May 2010, the Commission issued Decision [2010] IASC 202 [PDFPDF: 84 KB] [ReadSpeaker] permitting China Eastern Airlines to code share on Qantas services between Australia and Singapore.

Korea - 10 May 2010

The Commission has received an application [PDFPDF: 63 KB] [ReadSpeaker] from Qantas Airways Limited (ACN 009 661 901) (Qantas) seeking an allocation of unlimited capacity and frequency for all cargo services on the Korea route. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB 17 May 2010, with applications due by COB 24 May 2010. If no notice of intention is received by COB 17 May 2010, the Commission may proceed to decide the matters under consideration as soon as practicable after that date.

On 18 May 2010 the Delegate of the Commission issued Determination [2010] IASC 103 [PDFPDF: 90 KB] [ReadSpeaker] allocating unlimited capacity and frequency for all-cargo services on the Korea route.

Cook Islands - 30 March 2010

The Commission has received an application [PDFPDF: 80 KB] [ReadSpeaker] from Pacific Blue Airlines Pty Ltd (ABN 79 097 892 389) (Pacific Blue Australia) seeking an allocation of two frequencies per week on the Cook Islands route. The airline plans to add two B737-800 services per week on the route. An allocation of 360 seats per week is required to facilitate the two weekly services. Other applications for some or all of the capacity sought by Pacific Blue Australia are invited.

Please note that additional capacity entitlements for Australian carriers were concluded recently between the aeronautical authorities of Australia and the Cook Islands. There are now 2,660 seats per week of capacity available for allocation.

The closing date for notice of intention to make an application is COB 8 April 2010, with applications due by COB 15 April 2010. If no notice of intention is received by COB 8 April 2010, the Commission may proceed to decide the matters under consideration as soon as practicable after that date.

On 9 April 2010 the delegate of the Commission issued Determination [2010] IASC 102 [PDFPDF: 213 KB] [ReadSpeaker] allocating 360 seats of capacity in each direction to Pacific Blue for a period of five years.

Papua New Guinea - 12 March 2010

The Commission has received an application from Qantas Airways Limited (ACN 009 661 901) (Qantas) seeking an allocation of 888 seats of capacity per week on the Papua New Guinea route [PDFPDF: 60 KB] [ReadSpeaker]. The airline plans to introduce 12 Bombardier Dash8-Q400 services per week between Cairns and Port Moresby from July 2010. Other applications for some or all of the capacity sought by Qantas are invited.

The closing date for notice of intention to make an application is COB 19 March 2010, with applications due by COB 26 March 2010, unless additional time is sought and agreed to by the Commission. If no notice of intention to apply is received by COB 19 March 2010, the Commission may proceed to decide the matters under consideration as soon as practicable after that date.

On 24 March 2010, the Commission issued Determination [2010] IASC 101 [PDFPDF: 96 KB] [ReadSpeaker] which allocates 888 seats of capacity in each direction on the route to Qantas.

Fiji - 22 February 2010

V Australia has applied for a variation of Determination [2008] IASC 117 to transfer to Pacific Blue Australia the 360 seats of capacity per week allocated by the Determination (V Australia application) – [PDFPDF: 88 KB] [ReadSpeaker]. Submissions about the application are invited. The closing date for notice of intention to make a submission is 1 March 2010, with submissions due by 8 March 2010 unless additional time is sought and agreed to by the Commission.

If no notice of intention is received by cob 1 March 2010, the Commission may proceed to decide the matters under consideration as soon as practicable after that date.

On 2 March 2010 the Commission issued Decision [2010] IASC 201 [PDFPDF: 120 KB] [ReadSpeaker] varying Determination [2008] IASC 117 as requested by transferring from V Australia to Pacific Blue Australia the allocation of 360 seats of capacity per week.

Singapore - 26 October 2009

The Commission has received an application from Australian Indian Ocean Territories Airlines (AIOTA) for unlimited capacity between Christmas Island and Singapore. AIOTA plans to wet-lease a Boeing 737-300 from Our Airlines for these operations. AIOTA application. [PDFPDF: 121 KB] [ReadSpeaker] Other applications for the capacity are invited. The closing date for notice of intention to make an application is 2 November 2009, with submissions due by 9 November 2009, unless additional time is sought and agreed to by the Commission.

Update - 27 October 2009
