Below is a list of the Commission's completed cases in 2009.

Papua New Guinea - 30 June 2009

Qantas Airways Ltd (Qantas) has applied to the Commission for a variation to Determination [2006] IASC 129, which allocates capacity on the Papua New Guinea route, for continued authorization to use the capacity in code share services with Air New Guinea from 1 January 2010 until 31 December 2012 [PDFPDF: 419 KB] [ReadSpeaker]. Submissions about the application are invited. The closing date for notice of intention to make a submission is COB 23 July 2009, with submissions due by COB 30 July 2009 unless additional time is sought and agreed to by the Commission.

Update - 03 December 2009

The Commission has now finalised draft determination [2009] IASC 216 [PDFPDF: 148 KB] [ReadSpeaker], which proposes to authorise continued code sharing between Qantas and Air Niugini until 30 June 2012. Submissions about the draft determination are invited. Interested parties will have until 10 December to make a submission.

On 17 December 2009, the Commission issued Determination [2009] IASC 216 [PDFPDF: 158 KB] [ReadSpeaker] authorising the continued code share between Qantas and Air Niugini.

Papua New Guinea - 07 December 2009

Pacific Air Express has applied to the Commission for an allocation of 17.5 tonnes of cargo capacity per week on the Papua New Guinea route. The closing date for notice of intention to make an application is 14 December 2009, with applications due by 21 December 2009, unless additional time is sought and agreed to by the Commission.

On 17 December 2009, the Commission issued Determination [2009] IASC 134 [PDFPDF: 84 KB] [ReadSpeaker] allocating 17.5 tonnes of freight capacity to Pacific Air Express for five years from the date of the determination.

Papua New Guinea - 03 December 2009

Qantas applied to the Commission on 1 December 2009 to revoke Determination [2007] IASC 123, which allocated 17.5 tonnes of cargo capacity per week on the Papua New Guinea route. Qantas application [PDFPDF: 50 KB] [ReadSpeaker].

On 2 December 2009, the delegate of the Commission issued Decision [2009] IASC 220 [PDFPDF: 76 KB] [ReadSpeaker], revoking the determination.

Solomon Islands and Vanuatu - 10 November 2009

HeavyLift has applied to the Commission to revoke Determinations [2005] IASC 116 [PDFPDF: 96 KB] [ReadSpeaker] and [2007] IASC 102 [PDFPDF: 86 KB] [ReadSpeaker] which allocate capacity on the Solomon Island route and Determination [2005] IASC 115 [PDFPDF: 95 KB] [ReadSpeaker] which allocates capacity on the Vanuatu route. On 23 November 2009 the Delegate of the Commission issued Decisions [2009] IASC 217 [PDFPDF: 78 KB] [ReadSpeaker] and [2009] IASC 218 [PDFPDF: 78 KB] [ReadSpeaker] revoking the capacity on the Solomon Islands route, and Decision [2009] IASC 219 [PDFPDF: 76 KB] [ReadSpeaker] revoking the capacity on the Vanuatu route as requested.

Singapore - 26 October 2009

The Commission has received an application from Australian Indian Ocean Territories Airlines (AIOTA) for unlimited capacity between Christmas Island and Singapore. AIOTA plans to wet-lease a Boeing 737-300 from Our Airlines for these operations. AIOTA application. [PDFPDF: 121 KB ] Other applications for the capacity are invited. Indonesia - 06 October 2009

The Commission has received an application from Strategic Airlines to transfer to it capacity on the Indonesia route currently held by Ozjet Airlines. Ozjet is owned by Strategic Global and Strategic Airlines is also a wholly-owned subsidiary of Strategic Global. Strategic plans to commence a once weekly A330 service between Brisbane and Denpasar from 6 December 2009. It plans to introduce a second weekly service from 30 June 2010, subject to securing a small amount of additional capacity via the ‘spill-over” provisions of the Australia – Indonesia air services arrangements. Update - 17 December 2009

On 17 December 2009, the Commission issued Decision [2009] IASC 222 [PDFPDF: 90 KB] [ReadSpeaker] varying Determination [2008] IASC 101 [PDFPDF: 102 KB] [ReadSpeaker] by transferring from Ozjet to Strategic Airlines the allocation of 408 seats of capacity per week.

Fiji - 12 August 2009

V Australia has applied for an allocation of 1,267 seats per week on the Fiji route. V Australia plans to operate daily B777 services on the Fiji route. In order to obtain the total of 2,527 seats required for the operation of these services, V Australia also plans to used 1,260 seats which are proposed to be transferred from Pacific Blue Australia to V Australia.

In a related application, Pacific Blue Australia sought a variation of Determination [2008] IASC 129 to transfer to V Australia the 1,260 seats allocated by that determination. Pacific Blue Australia application [PDFPDF: 66 KB] [ReadSpeaker].

Other applications for the capacity sought by V Australia are invited. Submissions about the variation application from Pacific Blue Australia to transfer capacity to V Australia are also invited. The closing date for notice of intention to make an application or submission is 20 August 2009, with applications due by 27 August 2009 unless additional time is sought and agreed to by the Commission.

Other Applications

On 20 August 2009, the Commission received a letter of intention from Qantas for an allocation of capacity on the Fiji route. Qantas letter [PDFPDF: 41 KB] [ReadSpeaker]. Since both carriers have applied for the same limited capacity the Commission will write to both V Australia and Qantas and ask them to address the paragraph 5 criteria on the Ministers policy statement. Once these are received submissions about the capacity will be invited.

On 20 October 2009 the Commission issued Draft Determinations [2009] IASC 131 [PDFPDF: 177 KB] [ReadSpeaker] and [2009] IASC 132 [PDFPDF: 177 KB] [ReadSpeaker] proposing to allocate 907 seats per week to V Australia and 852 seats per week to Qantas. Submissions about the draft determinations are invited. Submissions are due by COB 30 October 2009. The Commission is expected to meet on 5 November 2009 to settle final determinations.

The Virgin Group has also sought to transfer an additional 360 seats from Pacific Blue Australia to V Australia by varying determination [2008] IASC 117 [PDFPDF: 92 KB] [ReadSpeaker]. Update - 06 November 2009

The Commission has now finalised the allocations proposed in the draft determinations [2009] IASC 131 and [2009] IASC 132, allocating 907 seats of capacity to V Australia and 852 seats of capacity to Qantas. The determinations are for 3 years. The airlines have already been advised of the outcome.

Renewal of determinations expiring in 2010 - 08 August 2009

Other applications for the capacity are invited. The closing date for notice of intention to make an application is 19 October 2009, with applications due by 26 October 2009, unless additional time is sought and agreed to by the Commission.

Update - 08 August 2009

On the 20 October 2009, the Commission renewed all of the determinations above. All of the determinations may be viewed under Determinations and Decisions.

Vietnam - 08 October 2009

The Commission has received an application from Qantas for unlimited capacity between points in Australia, other than Sydney, Melbourne, Brisbane and Perth, and authorised points in Vietnam. Qantas's wholly-owned subsidiary Jetstar Airways plans to add two additional services between Darwin and Ho Chi Minh City during peak periods of demand throughout the year. Thailand - 01 October 2009

Qantas has applied to the Commission for an allocation of 1.4 Boeing 747-400 equivalent units on the Thailand route, to allow Jetstar to add an additional two services between Sydney and Phuket during peak periods though the year. India - 21 September 2009

Qantas has applied to the Commission for a variation to Determination [2008] IASC 122 [PDFPDF: 74 KB] [ReadSpeaker] which allocates 1,175 seats in each direction. The variation sought is to allow Jetstar or any wholly-owned subsidiary of the Qantas Group to hold out joint services on the route. Qantas application. Thailand - 18 August 2009

The closing date for notice of intention to make an application is 25 August 2009, with applications due by the 1 September 2009 unless additional time is sought and agreed to by the Commission.

Papua New Guinea - 15 June 2009

As both carriers have sought the same limited capacity, this has created a contested situation. Accordingly, on 22 June 2009, the Commission wrote to both HeavyLift and Pacific Air Express asking them to address the paragraph 5 criteria on the Ministers policy statement,with responses due by COB 2 July 2009. On 6 August 2009, the Commission issued a Draft Determination [2009] IASC 117 [PDFPDF: 132 KB] [ReadSpeaker] proposing to allocate 16.5 tonnes of cargo capacity per week to HeavyLift. Submissions about the draft determination are invited. Submissions are due by cob Monday 17 August. The Commission is expected to move to a final determination as quickly as possible thereafter.

Pacific Wings Pty Ltd (Pacific Wings) has applied to the Commission for an allocation of 0.5 units of capacity per week in each direction on the New Caledonia route (France – Route 3). On 11 August 2009, the Commission issued Determination [2009] IASC 114 [PDFPDF: 94 KB] [ReadSpeaker] allocating 48 seats per week to Qantas.

France (Route 3) (New Caledonia) - 13 July 2009

On 13 July 2009, the Commission received an application [PDFPDF: 394 KB] [ReadSpeaker] from Strategic Global to revoke Determination [2008] IASC 107 [PDFPDF: 85 KB] [ReadSpeaker] which allocates to Ozjet 0.5 units of capacity per week on the New Caledonia Route. Strategic is the new owner of Ozjet, which retains its separate company identity.

Solomon Islands - 01 July 2009

Pacific Wings Pty Ltd (Pacific Wings) has applied to the Commission for an allocation of unlimited capacity on the New Zealand route and 0.25 units of capacity per week in each direction on the New Caledonia route. As part of the usual procedure the IASC sent a letter to the Department of Infrastructure, Transport, Regional Development and Local Government to request advice as to whether Pacific Wings is reasonably capable of obtaining designation, licensing and the operational approvals necessary to operate services on the route. On 27 July 2009, the Commission issued Determination [2009] IASC 111 [PDFPDF: 103 KB] [ReadSpeaker] allocating unlimited passenger capacity on the New Zealand route and [2009] IASC 112 [PDFPDF: 103 KB] [ReadSpeaker] allocating 0.25 units of capacity per week in each direction on the New Caledonia route.

On 18 June the Commission received a letter from Sky Air Worlds Liquidators [PDFPDF: 34 KB] [ReadSpeaker] seeking to revoke Determination [2007] IASC 121 for the Solomon Islands route and [2009] IASC 102 for the Indonesia route.

Update - 22 June 2009

As both carriers have sought the same limited capacity, this has created a contested situation. Accordingly, on 22 June 2009, the Commission wrote to both HeavyLift and Pacific Air Express asking them to address the paragraph 5 criteria on the Ministers policy statement, with responses due by COB 2 July 2009. The paragraph 5 material from each applicant will be added to the website as it becomes available.

The Commissionis inviting submissions from interested parties about the HeavyLift and Pacific Air Express applications. The closing dates for notice of intention to submit and to make a submission are COB 9 and 16 July 2009 respectively.

United Kingdom and Thailand - 15 June 2009

Qantas Airways Limited has applied to the Commission for a variation to Determinations [2006] IASC 105 and [2006] IASC 110 to enable code sharing by Iberia on Qantas services on the Untied Kingdom and Thailand routes.
